If you are using the Site on behalf of any third party or other entity you warrant that you are able to accept these terms on that party’s or entity’s behalf. These terms and conditions should be read with our Privacy Policy.

This Site is owned by Aditya Multimedia & Entertainment Limited (“Aditya Multimedia & Entertainment”). All materials contained in and displayed as part of this site, including but not limited to text, graphic, audio, and data content are owned by Aditya Multimedia & Entertainment, it’s licensors, content providers, partners and clients.

2. Use of the site

This Site is designed for use by content providers and clients of Aditya Multimedia & Entertainment to upload and license music and other materials. You may not use the Site for any purpose unrelated to, or detrimental to this intent. Users of this Site are specifically prohibited from:

1. downloading, reverse engineering any software, storing, copying, or hosting any section or part of the Site unless such is specifically permitted by a written agreement with Aditya Multimedia & Entertainment;
2. collecting data or information from the Site using bots, data miners or other automated data gathering methods;
3. display the Site or any part thereof out of its original context, deeplinking or in other websites other than for the purposes of legitimate review [or if you are a referrer];
4. using or subscribing to the Site with false or inaccurate registration information, accessing any party’s account without the express permission of that party;
5. defaming anybody or making comments of a derogatory or obscene or offensive manner or otherwise use this site or its content in a way that brings Aditya Multimedia & Entertainment or any third party into disrepute or causes Aditya Multimedia & Entertainment to be liable to any third party;
6. using the Site in any manner intended to disadvantage or harm Aditya Multimedia & Entertainment or any of it’s contributors, licensors, partners or clients, and using the site for anything other than legitimate and benign purposes;or
7. using this site to distribute viruses or malware or other similar harmful software code.

3. Copyright and copyright violations

All rights title and interest in all materials which are capable of protection by copyright or other intellectual property right are the property of Aditya Multimedia & Entertainment or its contributors unless otherwise stated. Any violation of copyright by Site users will result in the immediate suspension and/or termination of account, services and/or agreements. Aditya Multimedia & Entertainment will prosecute any such breach to the fullest extent of the law.

4. Copyright infringement

If any of the material contained in or displayed by the website appears to be in violation of copyright owned by you or the party that you represent please inform Aditya Multimedia & Entertainment of such apparent infringement at the earliest possible opportunity using the information in the “contact us” section of this website.

5. Intellectual property

The logos, concepts, look, feel and function of this website are the intellectual property of Aditya Multimedia & Entertainment and any duplication or plagiarism thereof will be prosecuted to the maximum extent possible under Indian law.

While Aditya Multimedia & Entertainment may from time to time provide links to 3rd party sites, it is not responsible for the content of third party websites, nor for the consequences of any use of such sites by Aditya Multimedia & Entertainment users.

7. Adult content

Some material hosted by Aditya Multimedia & Entertainment on this Site may contain adult themes or explicit lyrics, please be aware of this and use the site responsibly.

8. Account data and security

When submitting information to Aditya Multimedia & Entertainment, particularly during registration, please ensure that all information submitted is current and accurate, and that your submitted information is updated if it changes. Make sure that you maintain the secrecy and security of your account details and password in particular. You are wholly responsible for any unauthorised access to your account that occurs as a result of a lapse of security on your part, and you must notify Aditya Multimedia & Entertainment of any such access or suspected access immediately.

9. Fees and payments

You may purchase digital downloads from the catalogue of tracks that Aditya Multimedia & Entertainment holds on the Site (“Transaction(s)”). You warrant that if you enter into a Transaction, you shall be able to make full and immediate payment for the requested products or services. There are distance selling regulations that apply to downloads of music from this Site but the supply of digital downloads is the supply of service and although you have a cooling off period of 7 days after you have ordered the Track as soon as you have requested that Aditya Multimedia & Entertainment provide the Service (i.e. commence the download) then you do not have any further rights to cancel.
You warrant that if you enter into a Transaction, you shall be able to make full and immediate payment for the requested products or services.

10. Disclaimer

You agree that your use of the Site is on an ‘as available’ basis. Except as otherwise expressly required by applicable law, Aditya Multimedia & Entertainment makes no representations, warranties, conditions or other terms (whether express or implied) in relation to the provision of the Site, including without limitation as to completeness, accuracy and currency or any content on the Site, or as to satisfactory quality, or fitness for particular purpose.
To the maximum extent permitted by applicable law, Aditya Multimedia & Entertainment excludes all liability (whether arising in contract, tort, breach of statutory duty or otherwise) which Aditya Multimedia & Entertainment may otherwise have to you as a result of any error or inaccuracies in any content, the unavailability of the Site for whatsoever reason, and any representation or statement made on the Site.
Aditya Multimedia & Entertainment will not be liable for any loss or damage Aditya Multimedia & Entertainment causes which Aditya Multimedia & Entertainment could not reasonably anticipate when you started using the Site and/or the acts or omissions of any third party such as other users of the Site or any other indirect or consequential loss or damage you may incur in relation to the Site and its content.
Under no circumstances shall Aditya Multimedia & Entertainment aggregate liability to you for any and all claims arising from your use of the Site (including the downloading or use of any tracks) exceed the amount paid by you to Aditya Multimedia & Entertainment for all Transactions.
Notwithstanding any other provision of these terms and conditions, Aditya Multimedia & Entertainment does not exclude or limit our liability for death or personal injury arising from our negligence, for any fraudulent misrepresentation made by Aditya Multimedia & Entertainment on the Site or for any other statutory rights which are not capable of being excluded.

11. Governing law

This document and all other agreements and aspects of the Site are governed by the law of India and subject to the courts of India. By using this Site and/or any of the services provided by Aditya Multimedia & Entertainment you agree that all business conducted between you and Aditya Multimedia & Entertainment shall be subject to the laws of India, and any dispute that may arise between you and Aditya Multimedia & Entertainment concerning any element of Aditya Multimedia & Entertainment business shall be subject to the exclusive jurisdiction of the courts of India.

12. Suspension and termination

Aditya Multimedia & Entertainment reserves the right to suspend or terminate your account or your access to the Site at any point.
